Different Hotels NV makes all reasonable efforts to ensure that this information is correct at the time of inclusion, which does not prevent the information on this site from being incomplete, inaccurate or out of date at all times. Different Hotels NV reserves the right to add to, change, correct or remove the information offered at any time, without any notification and without this giving rise to any liability on the part of Different Hotels NV. Different Hotels NV explicitly excludes any guarantee or warranty in connection with the information provided as far as legally possible and cannot in any case be held liable for any direct damage or consequential damage. The copyright on all information offered rests with Different Hotels NV and this information may therefore not be reproduced or communicated without prior and express permission from Different Hotels NV.

 

 

general terms and conditions of sale of different hotels NV

Article 1.

Except for special written provisions issued by an authorised person, the present general terms and conditions apply to all commitments of Different Hotels NV. These conditions are mentioned in this offer and are thus sufficiently notified. The tacit acceptance is sufficiently demonstrated by visiting our premises or receiving our documents or services.

 

Article 2.

Performance and rates are freely determined by the Management, which reserves the right to change them.

 

Article 3.

The hotel owner shall only be liable for damage, destruction or theft of items brought into the hotel by a hotel guest staying at the hotel, up to a maximum amount of one hundred times the lodging charge per day of the sleeping accommodation unless the item was effectively left in safekeeping, the hotel owner refused to take securities, money and valuables into safekeeping or if the damage resulted from the hotel owner's fault the hotel owner cannot be held liable if the damage is due to the guest himself or the person accompanying him, visiting him or employed by him; theft committed by force of arms, or the nature or defect of the object. Under penalty of forfeiting the right to compensation, the hotel guest must report the damage to the hotel owner immediately after it has been established.

 

Article 4.

Different Hotels NV, if they so wish, by operation of law and without having to provide justification, subject any acceptance of an order, any reservation or any performance to be delivered or put forward to full or partial payment of the amounts that are or will become due to it, even under the form of advance payment, discount or full settlement, even anticipatively.

 

Article 5.

Any dispute belongs to the exclusive jurisdiction of the court in Tongeren and unless otherwise provided by law, Belgian law will apply. We reserve the right to waive this clause upon collection.

 

Article 6A - cancellation conditions 1 to 9 rooms

Standard cancellation conditions:

Advanced Purchase Rate

The advanced purchase option requires full prepayment at the moment of making the reservation. This is a non-refundable payment, therefore the reservation is not cancellable. In case of cancellation, modification or no-show, the full amount will be charged and no refund will be given. These conditions apply to reservations made through differenthotels.com.

Semi-Flexible Rate

The Semi-flexible option is free for cancellation up to 48 hours before your scheduled (check-in time 15:00) arrival date. If cancellation occurs within 48 hours before the arrival date, the full amount of the reservation will be charged. These conditions apply to reservations made via differenthotels.com.

Flexible Rate

Our Flexible option is cancellable free of charge until 11:00 on the day of arrival. If cancellation occurs after this time, the full amount of the reservation will be charged. These conditions apply to reservations made through differenthotels.com.

 

Article 6B. - Payment and cancellation conditions groups (from 10 rooms):

Partial cancellation

  1. From the date of signing the contract and up to 90 days before the date of the event, 30% of the number of participants per day can be cancelled free of
  2. Between 89 and 30 days before the event, the number of participants per day can be reduced by 20% at no cost.
  3. Between 29 days and 7 days before the event, the number of participants per day may be reduced by 10% free of charge.
  4. On 6 days or less before the event, a reduction in the number of participants can no longer be taken into account and the event will be charged in full.

 

Full cancellation

  1. From the date of signing the contract until 90 days before the event, the hotel will charge 30% of the value of the event as a handling fee.
  2. Between 89 and 60 days before the event, the hotel will charge 40% of the event value.
  3. Between 59 and 30 days before the event, the hotel charges 60% of the event
  4. Between 29 days and 7 days before the event, the hotel will charge 80% of the event value.
  5. 6 days or less before the event, the hotel will charge the full value of the event.

Cancellation policy applies only to the entire reservation and is not applicable to single or multiple nights within the reservation.

For any group booking of 10 rooms or more, payment is as follows:

Domestic (Belgian companies or individuals): First deposit to be paid upon signature, amounting to 50% of the reservation value upon confirmation; 10 days before event 25%; the remaining 25% plus any extras may be invoiced.

Foreign companies or persons: First deposit is made upon signature, to be paid 100% of the reservation value upon confirmation. It is not possible to send invoices abroad. Extras must be paid on site.

NPOs, MICE offices, clubs, associations, private parties and other intermediaries at home and abroad: 100% of the reservation value upon confirmation. Extras must be settled on site. It is not possible to send an invoice.

Any stay of any size must always be paid in advance of the reservation. Should you have extended your stay and fail to pay, the hotel reserves the right to hold the items in the room until the full amount is paid.

 

Article 7

The customer will provide a credit card upon check-in, the details of which will be recorded by the respective Different Hotel. If the customer does not make the payment within the agreed period, or makes use of facilities (e.g. minibar, wellness, bar, restaurant, etc.) that are not declared at check-out, the hotel will be entitled to deduct them via the credit card, on the sole condition that the detail of the statement is delivered to the customer, either electronically or by post. In any case, the customer must protest the payment made in writing within 8 days if he believes it was not rightfully made.

 

Additional provisions

Price increases

Different Hotels NV reserves the right to adjust the prices of our products/services (labour, or e.g. purchase of food and beverages) if the market price of raw materials (given that we work with daily fresh products, where the price can fluctuate briskly), labour or other relevant costs increase. Such price changes (which will not be limited to the above) will take effect after written notification to the Customer.

 

Supplements for Allergies and Allergens

In cases where adjustments have to be made to the product or service to meet the specific needs of the Customer regarding allergies or allergens, Different Hotels NV reserves the right to charge any supplements for these adjustments. These supplements will be communicated to the Customer in writing prior to delivery. By agreeing to these terms and conditions, the Customer agrees to the above provisions regarding price increases and supplements for allergies and allergens. "**

Payment terms

  1. The payment term of an invoice drawn up by Different Hotels NV or an invoice drawn up by one of the hotels is 7 days, counting from the day the invoice was sent.
  2. If payment is not received within the stipulated period, Different Hotels NV will proceed to send reminders to highlight the payment arrears.
  3. The first reminder is sent when the invoice has not been paid by the due date and the payment term of this first reminder is 7 days.
  4. If payment is not made after the first reminder, a second reminder will be sent when the due date of the first reminder has passed. The payment term of this second reminder is 7 days and in addition, Different Hotels reserves the right to add 2% administration costs of the total amount of the invoice in this second reminder.
  5. Should payment fail to occur after the second reminder, Different Hotels will send a notice of default in which Different Hotels reserves the right to charge an additional 10% administration fee. The payment term of this notice of default is 5 days.
  6. If payment is not made after the notice of default, Different Hotels NV reserves the right to hand over the outstanding amount including the 12% administration fee to a collection agency. The collection costs shall be borne by the debtor.
  7. Different Hotels NV reserves the right, in the event of persistent late payment, to take further action in accordance with the applicable laws and regulations.
  8. All costs and any judicial or extrajudicial (collection) costs incurred by Different Hotels NV to obtain satisfaction - both in and out of court - shall be borne entirely by the debtor.
  9. Payments should be made without any discount, settlement or suspension, unless otherwise agreed in writing with Different Hotels.
  10. Non-compliance with payment obligations may result in the temporary suspension of further services and/or termination of future collaborations with the These decisions may be taken by operation of law and without notice. All property of the hotel guest located in the hotel shall be retained as further security for payment of the amounts due. Any complaint about the quality of services received must be formulated within 3 days of delivery. Any complaints about the correctness of the invoice must be formulated in writing within 7 days after sending the invoice.

Liability

The hotel is not liable for damage to cars and theft of items left in the car, loss or disappearance of valuables not stored in the safe in the room or at the reception, or goods left unattended in public areas, corridors or meeting rooms.

In case of force majeure, the hotel is not liable for any partial or total non- performance of the contract due to any unforeseen event caused by third parties, government measures or force majeure, including but not limited to strikes, lock downs, floods, fire or terrorist attacks.

Smoking

All our hotels and hotel rooms are strictly smoke-free. The hotel reserves the right to charge a flat rate of €250 as a cleaning fee to guests who smoke in the hotel or in a room.

Use of the accommodation and liability for damage  

 The tenant/user/visitor of the accommodation agrees to treat the rented room (including the common areas of the accommodation) with care and respect. It is strictly prohibited to misuse, damage or deliberately pollute the room (or such common areas) in any way, including, but not limited to, causing damage by vandalism, leaving bloodstains, human waste, or using prohibited products such as drugs, candles, candle wax and other similar substances.  

The tenant/user/visitor shall be liable for any damage caused to the accommodation as a result of breach of this provision. In addition to the cost of repairing such damage, the tenant/user will also be charged damages of €250 per violation. The management reserves the right to take further legal action in case of serious violations. 

Posters

It is not allowed to fix posters on walls, floors or ceilings, with staples or otherwise.

The customer is responsible for repairing any damage resulting from non-compliance with these rules.

 

Bringing pets to the hotel

To maintain the cleanliness and hygiene in our accommodation, we would like to emphasise that (domestic) animals/dogs are never allowed on or in the bed (not even in a basket).

In addition, washing or cleaning pets in the shower, bathtub, sink or other such places in the room/hotel is not allowed.

If this rule is violated, a fine of 150 euros will be charged first, as we will have to clean the room carefully afterwards to make it completely allergy-free. Additionally, any repair costs to fix the damage done will also be charged.

Separate charges will be levied for any damage such as scratching or biting to e.g. furniture, accessories, doors. We ask all bookers who bring their pet (with emphasis on dogs) to Different Hotel to provide a deposit of 250 euros or a credit card guarantee. This deposit will be fully refunded after your stay, provided no 1 of the above is found in the accommodation.

Gift vouchers
Different Gift Vouchers have a validity period of up to 1 year.
The gift voucher can be used 1 time and any remaining value will expire after its use, unless otherwise agreed with Different Hotels. Gift vouchers are not redeemable for cash.

Invoicing and Payment Terms  

All invoices for services and/or products delivered to Different Hotels NV must be sent and received by Different Hotels NV at the latest within 30 days of the service or product(s) purchased by Different Hotels NV. 

Price

1. The rates stated on the differenthotels.com website and underlying websites of the hotels are in euros and include the applicable VAT - rates.

2. If promotions or temporary actions are made, after creating your reservation (at any platform ) the prices will not be adjusted to the temporary reduced prices under any circumstances.

3. Our general check-in (15:00) and check-out (11:00) times apply at Belgium Different Hotels.
